Terms and Conditions

1. Remote Virus Removal Services: Our virus removal services may be offered to you over the Internet if you have a broadband (cable or DSL) Internet connection and your operating system is Microsoft Windows XP or newer. If you choose to have us provide our remote virus removal service to you, a The Virus Removal King (TVRK) technician will remotely log onto your PC through your broadband connection. Remote support will involve the installation of software onto your computer that will allow a Virus Removal King technician to provide the remote support services. Any such software will be removed at the end of the remote session.

2. Receipt Of Services: If you choose to have us provide our remote virus removal service to you, you agree to allow a Virus Removal King technician to use whatever tools are necessary to repair your computer, including remote access. You understand that if remote access is used on your computer there will be no residual software from the remote session except in cases where you request additional software, such as antivirus software; however, there may be one or more text files placed on your computer that will explain the work that was done on your computer. A copy of the log files will also be retained by The Virus Removal King for our records. If such text files are placed on your computer, you have the option to either save the files for future reference or to delete them from your computer.

3. MINIMUM SYSTEM REQUIREMENTS:
a) Operating system password must be available for the technician
b) Microsoft Windows XP operating system or later
c) Must have a working cable or DSL high speed internet connection

4. Your Responsibility: You agree and understand that prior to contacting or allowing The Virus Removal King to perform virus removal or other services on your computer, it is your responsibility to back-up the data, software, information or other files stored on your computer disks and/or drives. You acknowledge and agree that The Virus Removal King shall not be responsible under any circumstance for any loss or corruption of data and/or software.

5. SERVICE LIMITATIONS; LIABILITY:
a. LIMITATIONS TO SERVICE: The Virus Removal King reserves the right to refrain from providing any or all requested remote services and instead refund your payment, wholly or in part, if it is reasonably determined by a Virus Removal King technician that your technical needs or other requirements are unusual, extensive or beyond the scope of this Service Agreement.
b. FORCE MAJEURE: If a Virus Removal King technician's ability to render remote services is impaired by you or circumstances beyond the control of the technician, The Virus Removal King may choose not to provide or to discontinue remote services.
c. LIMITATION OF LIABILITY: To the extent permitted by law, you agree that The Virus Removal King’s total liability for damages related to its remote services is limited to the total amount you pay for the remote services, and you release The Virus Removal King from liability for any indirect, incidental, special, or consequential damages. THE VIRUS REMOVAL KING IS NOT LIABLE FOR LOSS, ALTERATION, OR CORRUPTION OF ANY DATA OR FOR YOUR INABILITY TO USE YOUR COMPUTER EQUIPMENT OR OTHER PRODUCT.

CHANGES, CANCELLATIONS AND REFUNDS:
Refunds will not be given after a service has been initiated unless The Virus Removal King determines that the service cannot be provided due to an error on the part of The Virus Removal King. Refunds will not be issued due to client error, connection failure or acts of God. In such cases The Virus Removal King will initiate another connection to the client prior to 5:00pm (CST) of the following day in order to complete the service(s). It is the client's responsibility to contact The Virus Removal King via an official Service Request with a convenient time to re-initiate the Remote Online Support Service connection. The Virus Removal King will make every effort to complete the service(s) in a timely fashion but cannot guarantee completion in cases of client delay or client connection issues. Cancellations will be accepted at any time up to 30 minutes prior to the start of service. A cancellation fee of $15 will be charged.

Terms and Conditions for Data Recovery Services

DATA RECOVERY IS NOT GUARANTEED: The Virus Removal King, LLC (TVRK) agrees to use its best effort to attempt said recovery, and CLIENT agrees that TVRK is in no way liable in the event TVRK is unsuccessful in recovering data on the data storage devices. TVRK assumes no liability for damage to CLIENT's property during shipment or for uninsured shipments.

MANUFACTURER WARRANTY MAY BE VOID ON MEDIUM: Although most manufacturers will honor product warranties following data recovery procedures, in no way shall TVRK be liable if CLIENT's manufacturer warranty is VOID due to any action taken by TVRK.

SERVICES ESTIMATE: TVRK agrees to evaluate media for data recovery free of charge or at a pre-quoted cost to CLIENT. Following the evaluation, TVRK will furnish CLIENT with a written recovery proposal containing a guaranteed-not-to-exceed data recovery cost. Upon written approval of the cost estimate by CLIENT, TVRK will proceed with the recovery.

PAYMENT: CLIENT agrees to pay TVRK for all services provided to CLIENT following CLIENT's acceptance of the written recovery proposal. All fees are quoted in US currency. CLIENT's final bill is due upon receipt of an invoice from TVRK.

DATA SECURITY: CLIENT data remains property of the CLIENT at all times. TVRK will only access said data in an attempt to determine viability during recovery efforts. TVRK holds all CLIENT data in strict confidence. TVRK will not share or make CLIENT data available to others for any reason. A copy of recovered data is maintained in a secure manner for a period of five (5) days following recovery to allow CLIENT sufficient time to create a copy of the data, and to guard against failure of return media or damage in transit. TVRK will destroy copies of CLIENT data at the end of five (5) days following return to client, and the media will be securely erased to Department of Defense standards so as to prevent subsequent recovery of the data from the storage media.

DATA TRANSPORT MEDIA: Recovered data will be returned on a media device of mutual agreement at the time of recovery.

ABANDONED HARDWARE: All items left with TVRK will be considered abandoned and the property of TVRK to dispose of as deemed by TVRK in the event that CLIENT does not respond or lay claim within ninety (90) days of last confirmed communication.
